Branded Hospitality Media, LLC ("Branded," "we," "us," or "our") operates branded.network (the "Site") and the Branded Media Network (the "Network"). This Privacy Policy explains what we collect, why, how we use it, and the rights you have. It applies to the Site and to our related media and advertising activities.

1. Who we are (data controller)

Branded Hospitality Media, LLC, 235 Park Avenue South, New York, NY, United States. Privacy contact: media@branded.nyc. For the purposes of the EU/UK General Data Protection Regulation ("GDPR"), Branded is the controller of personal data collected through the Site.

2. Information we collect

Information you give us. Name, email address, company, show name, and any other details you submit when you contact us, list a show, subscribe to a newsletter, or apply to advertise.

Information collected automatically. IP address, approximate location derived from IP, device and browser type, operating system, referring URL, pages viewed, links clicked, and time spent on pages. This is collected through cookies and similar technologies (see our Cookie Policy).

Advertising and measurement data. Where we or our partners serve or measure advertising, we and they may process IP address, device identifiers, approximate location, and listening or browsing activity to deliver, cap, and measure ads. See Section 7.

Information from third parties. Publicly available show information (titles, hosts, artwork, descriptions, feed and platform links) and analytics or performance data that show partners or platform partners provide to us.

We do not knowingly collect special categories of personal data (such as health, biometric, or political data), and we ask that you not submit them to us.

3. How we use information

  • To operate, maintain, and improve the Site and the directory.

  • To respond to inquiries and communicate with you.

  • To review and process show listing submissions and manage Network participation.

  • To send newsletters or updates where you have asked to receive them.

  • To sell, serve, cap, and measure advertising, and to report performance to partners and show partners.

  • To analyze usage, audience, and performance of the Site and the Network.

  • To protect the Site, prevent fraud and abuse, and enforce our Terms of Service.

  • To comply with legal obligations and to establish, exercise, or defend legal claims.

4. Legal bases for processing (EEA/UK)

Where GDPR applies, we rely on the following legal bases:

  • Consent — for non-essential cookies, targeted advertising, and marketing emails. You may withdraw consent at any time.

  • Contract — to provide services you request, including listing a show or participating in the Network.

  • Legitimate interests — to operate and secure the Site, understand audience and performance, and grow the Network, balanced against your rights.

  • Legal obligation — to comply with applicable law.

5. Cookies and similar technologies

We use cookies and similar technologies for essential site function, analytics, and (where permitted) advertising. In the EEA and UK, non-essential cookies are set only with your consent, collected through our cookie banner. You can change or withdraw your choices at any time. 6. How we share information

We do not sell personal information for money. We may share information with:

  • Service providers that host, operate, secure, or analyze the Site on our behalf, under contract and only for those purposes.

  • Advertising and measurement partners, including ad platforms and demand partners, to deliver and measure advertising across the Network.

  • Distribution and media partners, in connection with distribution or promotion of Network content.

  • Show partners, limited to aggregated or performance data relating to their own show.

  • Professional advisors, including counsel, auditors, and insurers.

  • Authorities or others where required by law, to enforce our terms, or to protect rights, safety, or property.

  • Successors in connection with a merger, financing, acquisition, or sale of assets.

A note on "sale" and "sharing" under US state law. Some US state privacy laws define "sale" or "sharing" broadly to include disclosures for cross-context behavioral advertising, even where no money changes hands. To the extent our advertising activities fall within those definitions, US residents may opt out as described in Section 10.

7. Advertising

The Network is supported by advertising. Advertising on or through the Network may be delivered by third-party technology partners, which may process device identifiers, IP address, approximate location, and activity data to serve, frequency-cap, and measure ads, including on a cross-context basis where permitted. These partners act as independent controllers or as our processors depending on the arrangement. Where consent is required, we collect it through our cookie banner. You may opt out of interest-based advertising through the industry tools listed in Section 10 and through our cookie preferences.

8. International transfers

We are based in the United States and our service providers may process data in the United States and other countries. Where we transfer personal data from the EEA or UK, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses (and the UK Addendum or IDTA where applicable), together with supplementary measures where needed. You may request a copy of the relevant safeguards by contacting media@branded.nyc.

9. Retention

We keep personal data only as long as needed for the purposes described here, then delete or de-identify it. Indicative periods: inquiries and correspondence, up to 3 years after last contact; newsletter subscribers, until you unsubscribe plus a short suppression record; show listing and partner records, for the relationship plus up to 7 years for tax, accounting, and legal purposes; analytics and log data, typically up to 26 months. Where a longer period is required by law or to defend claims, we retain for that period.

10. Your rights and choices

EEA / UK (GDPR). Subject to conditions, you have the right to access, rectify, erase, restrict, or object to processing, the right to data portability, the right to withdraw consent at any time without affecting prior processing, and the right to lodge a complaint with your supervisory authority. In the UK, that is the Information Commissioner's Office.

United States (including California, Colorado, Connecticut, Virginia, Texas and other states with comprehensive privacy laws). Subject to conditions, you may request to know or access the personal information we hold, request deletion, request correction, and opt out of targeted advertising and of any "sale" or "sharing" as those terms are defined by applicable law. California residents may also request details about categories collected, sources, purposes, and recipients, and may designate an authorized agent. We will not discriminate against you for exercising these rights.

How to exercise. Email media@branded.nyc with your request. We will verify your request, typically by confirming control of the email address on file, and respond within the time required by applicable law. If we decline, we will tell you why and how to appeal.

Opt-out signals. Where required, we honor opt-out preference signals such as Global Privacy Control (GPC).

Interest-based advertising opt-outs. You can also use the industry tools at the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), and, in Europe, Your Online Choices (youronlinechoices.eu).

Marketing email. Every marketing email includes an unsubscribe link. Transactional messages about a listing or an account may still be sent.

11. Third-party sites and platforms

The directory links to podcasts and content hosted on third-party platforms such as Apple Podcasts, Spotify, and YouTube, and to show partners' own websites. Once you follow those links, you are subject to those parties' privacy policies and terms, not ours. We do not control and are not responsible for their practices.

12. Children

The Site is a business-to-business resource intended for adults and is not directed to children. We do not knowingly collect personal data from anyone under 16. If you believe a child has provided us personal data, contact media@branded.nyc and we will delete it.

13. Security

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

14. Changes

We may update this Privacy Policy from time to time. We will change the "Last updated" date and, where the change is material, provide more prominent notice. Continued use of the Site after an update means you accept the revised policy.
